Charles Downing (died October 24, 1841) was a 19th-century American lawyer and territorial politician who served as a Delegate to the U.S. House of Representatives for two terms from the Florida Territory from 1837 to 1841. He was born in Virginia, although the exact date and circumstances of his birth are not known. Little is recorded about his early years, but his later professional activities indicate that he pursued legal studies and prepared for a career in the law at a time when Florida was transitioning from Spanish to American control and its territorial institutions were still being formed.

After studying law, Downing was admitted to the Florida bar and established his legal practice in St. Augustine, Florida, one of the oldest and most important settlements in the territory. As a practicing attorney in St. Augustine, he became involved in the civic and political life of the community, gaining experience in territorial legal matters and building a reputation that would lead to his entry into public office. His work as a lawyer in a frontier territory exposed him to the legal and political challenges of a developing region, including land claims, governance issues, and the integration of diverse populations under American territorial administration.

Downing’s formal political career began in the Legislative Council of the Territory of Florida, the principal lawmaking body for the territory under congressional oversight. As a member of this council, he participated in shaping early territorial legislation, contributing to the establishment of civil institutions and the legal framework that governed Florida prior to statehood. His service on the Legislative Council helped position him as a leading territorial figure and provided a platform for his subsequent election to national office.

In 1837, Downing was elected as a Delegate from the Florida Territory to the Twenty-fifth United States Congress and took office on March 4, 1837. He was re-elected and served in the Twenty-sixth United States Congress, with his second term concluding on March 3, 1841. As a member of the Unknown Party representing Florida, Charles Downing contributed to the legislative process during his two terms in office. Although territorial delegates did not possess full voting rights on the House floor, he participated in debates, served on committees, and represented the interests of his constituents at a time of significant national and regional change, including ongoing issues related to territorial governance, Native American relations, and the broader expansion of the United States. His service in Congress occurred during a significant period in American history, and he took part in the democratic process by advocating for the needs and priorities of the Florida Territory before the federal government.

Following the conclusion of his congressional service in March 1841, Downing returned to St. Augustine, where he resumed his legal and civic activities. His later months were spent in the same community where he had built his professional and political career. On October 24, 1841, Charles Downing died in St. Augustine, Florida. His death brought to a close a career closely tied to the early political development of the Florida Territory. His public legacy continued through his family, most notably his son, Charles W. Downing Jr., who went on to serve as Secretary of State of Florida, extending the Downing family’s involvement in the political life of the state.
